1. Introduction
These Terms and Conditions (“Terms”) govern the provision of photography services by Sean Shannon Photography (“we”, “us”, “our”) to you (“the Client”).
By booking or using our services, you agree to these Terms.
2. Services
We provide professional headshot and portrait photography services, including photography sessions, image editing, and digital image delivery.
Specific details of each booking will be agreed in advance.
3. Booking and Payment
3.1 Booking Confirmation
A booking is confirmed once session details are agreed and, where applicable, payment or a deposit has been received.
3.2 Fees
All fees will be communicated in advance.
3.3 Payment Terms
Payment terms will be specified at the time of booking.
4. Cancellations and Rescheduling
Clients must notify us as soon as possible of any cancellations or rescheduling requests.
We reserve the right to retain a deposit or charge a cancellation fee, particularly for short-notice changes.
5. Arrival, Preparation, and Conduct
5.1 Punctuality
Clients are expected to arrive on time. Late arrival may result in reduced session time.
5.2 Wardrobe and Grooming Responsibility
Clients are fully responsible for their wardrobe, grooming, and overall appearance during the session.
We recommend arriving with clean, well-fitted clothing and a prepared, professional appearance. Where possible, clients should bring backup outfit options.
We are not responsible for issues relating to wardrobe or grooming, including but not limited to:
Wrinkled, damaged, or visibly soiled clothing
Poor fit or styling choices
Grooming issues such as hair, makeup, or shaving
While we may provide general guidance during the session, final responsibility remains with the client.
5.3 Physical Condition and Appearance
Clients are responsible for arriving in a condition suitable for professional photography.
We are not responsible for correcting or retouching temporary conditions such as:
Sunburn
Skin irritation or marks
Fatigue or signs of illness
Additional retouching beyond standard editing may be declined or charged separately.
5.4 Behaviour and Conduct
Clients are expected to behave in a professional and respectful manner during the session.
We reserve the right to refuse or terminate a session without refund if a client:
Arrives under the influence of alcohol or drugs
Consumes alcohol during the session without prior agreement
Behaves in a disruptive, unsafe, or inappropriate manner
6. Delivery of Images
Edited images will be delivered within 7 business days from date of receipt of selections via an online gallery or file transfer service.
Images will only be delivered once full payment has been received.
7. Image Selection and Editing
We retain creative control over editing style and final image selection unless otherwise agreed.
Additional retouching may incur additional fees.
8. Image Storage
We retain images for a limited period. Long-term archiving is not guaranteed, and clients are responsible for backing up their files.
9. Use of Images
9.1 Client Licence
Upon full payment, clients are granted a non-exclusive licence to use images for personal and professional purposes.
9.2 Photographer Rights
We retain copyright of all images.
We may use selected images for portfolio, website, social media, and marketing purposes unless the client requests otherwise in writing.
10. Limitation of Liability
Our liability is limited to the amount paid for the services.
We are not liable for indirect or consequential losses or for circumstances beyond our control.
11. Force Majeure
We are not liable for failure to perform due to events beyond our control.
12. Privacy
Personal information is handled in accordance with our Privacy Policy.
13. Governing Law
These Terms are governed by the laws of South Africa.
